This privacy policy describes how Orbula Inc. ("we," "our" or "us") collect, use, and share information in connection with your use of our website and services. We are committed to protecting and providing transparency about the information we collect from you and how we use it. The Service is operated by Orbula, Inc. (the “Company”, “we” or “us”) for users of the Service (“you”). This Privacy Policy sets forth our policy with respect to information that is collected from visitors to the Site and users of the App and/or the Services. Under applicable law, Orbula Inc. is the “data controller” of personal data collected through the Services.

Types of Data Collected

Information That You Provide: We collect information from you when you voluntarily provide such information, such as when you register for access to the Services or use certain Services. Information we collect may include but not be limited to username, email address, and any messages, images, or other content you send via the chat feature.

  • Data We Collect Automatically: When you interact with us through the Services, we receive and store certain information such as an IP address, device ID, and your activities within the Services. We may store such information or such information may be included in databases owned and maintained by affiliates, agents or service providers. The Services may use such information and pool it with other information to track, for example, the total number of visitors to our Site, the number of messages users have sent, as well as the sites which refer visitors to Orbula.
  • Info through other Services: You may give us permission to collect your information in other services. For example, you may connect a social networking service ("SNS") such as YouTube, Twitch, Instagram, Steam, Reddit, Facebook or Twitter to your Orbula account. When you do this, it allows us to obtain information from those accounts (for example, basic profile information).

Cookies are small text files that are placed on your computer or device by websites that you visit or HTML-formatted emails you open, in order to make websites work, or work more efficiently. We may use cookies, web beacons, pixel tags, or other similar technologies on the Websites to, among other things:
    • Collect statistics regarding your usage of the Websites;
    • Tailor information presented to you based on your usage of the Websites;
    • Help provide additional functionality to the Websites; and
    • Analyze use of our Services.

If you do not wish to receive personalized advertising that is delivered by third parties outside of the Discord Service, you may be able to exercise that choice through opt-out programs that are administered by third parties, including the Network Advertising Initiative (NAI), the Digital Advertising Alliance (DAA).Our Services currently do not respond to “Do Not Track” (DNT) signals and operate as described in this Privacy Policy whether or not a DNT signal is received, as there is no consistent industry standard for compliance.

Orbula uses the information we collect about you to:

  • Respond to your inquiries or fulfill your requests
  • Provide you with the Websites and Services
  • Provide you with any support that you may request
  • Drawing prize winners;
  • Notice prize winners via our messaging centre;
  • Facilitate your enrollment in customer newsletter programs
  • Diagnose Website and Service technical problems
  • Send you information that we believe may be of interest to you, such as Service announcements, newsletters, educational materials, and event information;
  • Send you administrative information such as notices related to the Services or policy changes;
  • Understand how the Websites and Services are being used in order to enhance and optimize them;

  • Prevent, detect, mitigate, and investigate fraudulent or illegal activity; and

Processing the Data

The information collected by Orbula is stored and processed by Orbula’s sub-processor, Digital Ocean, leveraging Digital Ocean data centers located within the United States and Canada. Processing of the information collected about you is only undertaken for the purposes described in this Privacy Policy.

Google Analytics is a web analysis service provided by Google Inc. How We Disclose Your Data

If we disclose your information, we require those we share it with to comply with adequate privacy and confidentiality requirements, and security standards.

Service Providers Processing Data on Our Behalf

We may use contractors and service providers to process the information collected about you on our behalf for the purposes described in this Privacy Policy. We contractually require service providers to keep information secure and confidential and we do not allow our data processors to disclose your information to others without our authorization, or to use it for their own purposes. However, if you have an independent relationship with these service providers their privacy statements will apply.

Law Enforcement

In certain instances, it may be necessary for Orbula to disclose the information that we’ve collected about you to government officials or otherwise as required by applicable law. No personal data will be disclosed to any law enforcement agency or governmental agency except in response to:

  • A subpoena, warrant or other process issued by a court of competent jurisdiction;
  • A legal process having the same consequence as a court-issued request for information, in that if Orbula were to refuse to provide such information, it would be in breach of local law, and it or its officers, executives or employees would be subject to liability for failing to honor such legal process; or
  • Where such disclosure is necessary for Orbula to enforce its legal rights pursuant to the laws of the jurisdiction from which such information was gathered.

Do-Not-Track

We retain the information that we collect about you for as long as your Orbula Community or Orbula for Work account is active or as needed to provide you Services. We also retain and use the information collected about you as necessary to comply with our legal obligations, resolve disputes, prevent and detect fraud, and enforce our agreements. We store the information collected about you for as long as is necessary for the purpose for which we collect it.

Accessing, Updating, Correcting or Deleting Your Data

You are able to view and update much of the information collected about you through your Orbula Community account, or Orbula for Work account. If you wish to cancel your account or request that we no longer use your information to provide you Services, contact us via the information below. We will respond to your request to access or delete your information within 30 days. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Orbula reserves the right to revise or modify this Privacy Policy. In such event, we will post a prominent notice on the Websites prior to the change becoming effective.
